Protection of Personal Data
1. Değer Teknoloji A.Ş. ("Shopier" or "Company") serves as an e-commerce solution that provides a platform for Buyers to purchase products offered for sale by Sellers on their own websites, social media accounts, and blogs.
2. Shopier has adopted privacy principles regarding personal information and data security to protect the privacy of Users ("Sellers and Buyers") and to enable them to benefit from the technological infrastructure at the highest level. These privacy principles have been established to be applied to data collection and/or data usage, including but not limited to personal data, via the website named www.shopier.com ("Website"). For the purpose of providing our services quickly, easily, and reliably, it is necessary to process and transfer the personal data provided by Users to Shopier to third parties. In this context, personal data shared with Shopier is processed in accordance with the provisions of the Constitution of the Republic of Turkey, the Law on Protection of Personal Data No. 6698 ("KVKK"), the Law on Regulation of Electronic Commerce No. 6563, the Turkish Penal Code, and relevant legislation.
3. This policy has been prepared to inform real persons whose personal data is processed by Shopier as the data controller, within the framework of Article 10 of the KVKK and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform. In this context, we have prepared this policy not only to fulfill our obligations arising from the legislation but also to provide a good customer experience to our users. In this scope, this policy includes information on the identity of the data controller and its representative, if any, the purpose for which personal data will be processed, to whom and for what purpose personal data can be transferred, the method and legal reason for collecting personal data, and other rights of the data subject listed in Article 11 of the KVKK.
4. Shopier may update this policy in case of changes to the applicable legislation, decisions of the Personal Data Protection Board, court decisions, changes in personal data processing and/or transfer methods, purposes, reasons, or similar developments. If this policy is updated, the updated text will be published on the Website. Shopier may publish other disclosure texts, rules, conditions, or other explanations on the Website within the scope of its activities regarding the processing and/or transfer of personal data.
5. Within the scope of the Services offered by Shopier, personal data is processed and transferred in accordance with Article 20 of the Constitution and Article 4 of the KVKK, based on one or more of the conditions specified in Articles 5 and 6 of the KVKK, by being kept for the period required by the laws or the purpose of personal data processing, in a manner that is:
- Lawful and fair,
- Accurate and up-to-date,
- Specific, explicit and legitimate,
- Relevant to the processing purposes,
- Limited and proportionate.
6. Personal data is processed in proportion to the purposes of the services provided by Shopier, for the purposes of continuing Shopier's activities, enabling it to provide better service, measuring and improving the quality of the service it provides, determining the preferences and needs of our customers and employees, processing and evaluating job applications, ensuring communication with persons who have established a business relationship with our Company, acting in accordance with applicable legislation, sending newsletters and notifications via e-mail, recording address and contact information for communication, carrying out transactions related to the establishment and performance of contracts, preparing all records and documents that will serve as a basis for processing in electronic or paper environment, evaluating Users' complaints and suggestions, and ensuring information security, with explicit consent in accordance with applicable legislation or without explicit consent if explicit consent is not required within the scope of applicable legislation. In this context, Shopier may record, store, update, disclose, transfer, classify, and process personal information about Users to the extent permitted by law.
7. When Users register with Shopier, they share their name, surname, full address, phone number, e-mail address, and bank and payment information they provide according to their preferences with the Company. The Company may process and/or use this information provided by Users for your purposes of using Shopier throughout the contractual relationship, without the need for further approval, and for a period not exceeding 10 (ten) years after the account is closed. Personal information provided by Users is generally confidential information and is considered personal data under the Law on Protection of Personal Data No. 6698. This information is kept confidential by the Company and, unless otherwise and explicitly stated, is not disclosed to third parties by the Company and is not shared with third parties.
8. Sellers and Buyers transmit some personal information (name, surname, institutional information, phone, postal address and/or e-mail address, and similar) to the Company by filling in various fields on Shopier. The Company may use this information, requested outside the purposes and scope determined by the Terms of Use and Membership Agreement, by the Company or persons with whom it cooperates, by keeping personal information anonymous. In this context, the Company may retain all information and data provided by Users, in accordance with the KVKK and applicable secondary legislation, by anonymizing it in a way that it cannot be associated with an identifiable real person in any way, even by matching it with other data, and may use anonymized data for statistical evaluations, market research, and similar purposes as it wishes.
9. In accordance with Article 4 of the KVKK, Shopier has an obligation to keep the personal data of data subjects accurate and up-to-date, so our users must share their accurate and up-to-date data with Shopier to fulfill these obligations. We would like to state that if your personal data changes in any way, you need to update your data by visiting the "Account Management > Account Information" section in your Shopier account.
10. Personal information provided by Users may also be used to contact Sellers and Buyers for any reason. In this context, Sellers and Buyers acknowledge and declare that by providing the information requested by the Company, the Company may use this information to contact them.
11. Information provided by Sellers and Buyers or information about transactions made through Shopier may be used by the Company and its collaborating institutions or persons for various statistical evaluations, market research, and similar purposes, by being anonymized, outside the purposes and scope determined by the Terms of Use and Membership Agreement.
12. Shopier, as a data controller, processes some of your personal data obtained during telephone calls made with the call center for the purposes of increasing service quality, measuring satisfaction and performance, effectively managing complaints, recording calls for statistical purposes, and using them as evidence in future disputes. In this context, your name, surname, phone number, voice recording, and call information are processed during the phone calls. In addition, your personal data processed within the scope of phone calls will be shared with the call center service provider and companies we receive services from for marketing activities related to the phone call.
13. As a rule, Users' personal data is not transferred to third parties without the explicit consent of the data subjects, within the rules specified in the KVKK and the purposes specified in this policy. However, personal data may be transferred to domestic and international third parties, our business partners, our performance assistants, and regulatory supervisory institutions and official authorities in line with our service and activity purpose or when required by relevant legislation, by taking the necessary security measures in line with the personal data processing purposes. Information to be provided by Users within the scope of using Shopier will be processed by the Company in accordance with the KVKK. In this context, the Company may share the personal information provided by Users with credit card service providers, payment service providers, internet service providers, real and legal persons providing mobile application and website software maintenance and support services, in addition to third parties with whom it has a contractual relationship.
14. Shopier may use online services, interactive applications, e-mail messages and advertisements, cookies, and other technologies. With these technologies, it can compare the information shared by Users with Shopier with publicly available information; it can detect the device's operating system, operating system language, processor type, browser version, device location, time zone, IP address, and similar information. In addition, the Company or third parties authorized by it may detect and use the Internet Protocol (IP) address of Sellers and Buyers if necessary to identify system-related problems and resolve technical problems that may arise.
15. Shopier may process information about products for which the purchase process has not been completed and send notifications to Buyers regarding the purchase of products to improve the shopping experience.
16. The Company may obtain information about Sellers' and Buyers' use of Shopier by using a technical communication file (cookie). Cookies are small text files that a website sends to the user's browser to be stored in the main memory. A cookie facilitates use by storing status and preferences about a website. Cookies help obtain statistical information about site visits and generate custom-designed advertisements and other dynamic content for Sellers and Buyers. Users can remove and reject these cookies from their browser at any time. You can find detailed information about cookies in the Cookie Policy.
17. Shopier collects and uses Users' personal information to operate and improve its services. These uses may include providing Users with more effective Customer service, facilitating the use of applications and services by eliminating the need to repeatedly enter the same information, conducting research and analysis to improve our application and services, and displaying customized content according to Users' interests and preferences. Special categories of personal data (religion, sect, ethnic origin, race, etc.) will not be requested or processed by Shopier without the explicit consent of the Users.
18. Passwords for Seller accounts should not be shared with third parties and should be formulated in a way that cannot be guessed by third parties. If Sellers share their password and other account information with third parties, the Seller will be responsible for all transactions made on behalf of the account. In the event of any security vulnerability regarding the security of the account and/or password, Sellers are obliged to immediately contact the Company.
19. Users' personal data will be collected only within the scope of Shopier's field of activity and in line with the collection purposes, stored for the periods required by the processing purposes and/or stipulated in the applicable legislation, not processed in excess of the rules specified in the KVKK, and if the reasons requiring processing cease to exist, it will be deleted, destroyed, or anonymized ex officio or upon the request of Users as the data subject, reserving the mandatory retention periods arising from other applicable legislation.
20. In certain situations, the Company may disclose information about Sellers and/or Buyers to third parties other than those explicitly stated in this Disclosure Text and Privacy Policy. These situations include, but are not limited to: complying with responsibilities imposed by applicable legislation, fulfilling the requirements of the Terms of Use and Membership Agreement and its annexes, and when it is necessary to provide information for an investigation conducted by the authorized authority in accordance with relevant legislation to request information about users, and other exceptional circumstances listed in the KVKK.
21. Due to their membership in Shopier, Users have the right to inquire whether their personal data has been processed, to request information about it if it has been processed, to inquire about the purpose of processing their personal data and whether it is used in accordance with its purpose, whether it has been transferred domestically or abroad; to request the correction of any missing or incorrect personal data; to request the deletion or destruction of personal data and to demand that this situation be notified to third parties to whom the personal data has been transferred.
22. To exercise these rights arising from the applicable legislation, Users may submit a written application to Shopier's address specified below, in accordance with Article 13 of the KVKK, with their name and surname and signature, their T.R. identity number if they are a citizen of the Republic of Turkey, or their nationality, passport number or identity number if any, residential or business address for notification, e-mail address and phone number for notification, and by attaching the subject of the request and the necessary information and documents to identify their identity. Applications will be evaluated by Shopier and concluded free of charge within thirty days.

23. This Disclosure Text and Privacy Policy will come into force on 16/08/2023 and will be valid for all Users as of the specified date.
